Lawyer says 17-year-old might not be competent to face charges
A teen arrested last weekend for allegedly trying to kill a man who insulted a rock band he liked might not be competent to face the charges against him, the teens lawyer said Tuesday.
There are a lot of mental health concerns in Darrens life at this time, public defender Andrei Maciag said of Darren Tongate, who has been charged with attempted murder in the attack.
Maciag raised the issue of competency and asked state Childrens Court Judge Barbara Vigil to order a mental evaluation for the 17-year-old. Vigil ordered the exam but denied Maciags request to release Tongate to his mothers custody and instead sent him back to the countys juvenile jail because of the extreme violent nature of the incident.
Santa Fe County Sheriff Greg Solano has said Tongate and Thomas Pe, 22, got into an argument Saturday during a party at an Airport Road apartment about the rock band, Insane Clown Posse. Pe told Tongate who was wearing an Insane Clown Posse T-shirt that the band sucked and Tongate took offense to the statement and allegedly stabbed Pe four times in the chest, head, back and underarm, Solano has said.
Pe was in critical but stable condition Sunday at St. Vincent Regional Medical Center. A hospital spokesman said Tuesday that he didnt have updated information on Pe.
Tongate admitted to aggravated battery with a deadly weapon in November 2003 and completed a probationary sentence a year later, said Ellen Russill, juvenile probation officer. He also was referred to the juvenile probation office in March 2006 after an argument with his mother in which he punched and broke a window, she said.
