http://www.newswithviews.com/Devvy/kidd323.htm I'm on my way to Southern California on business; then on to Northern California to be with my family on Thanksgiving. Because of my schedule this trip, I won't be doing any columns for two weeks, so I decided to get this election one done. I hope the Thanksgiving holiday might give people a little extra time to look real hard at all candidates running for president. Regardless of your political party affiliation, I sincerely wish all Americans a safe and enjoyable Thanksgiving with family and friends. Despite the massive problems we are facing, we still have much to be thankful for and with God's blessings, we will find the strength to continue our fight for America's future. As someone who has been in the trenches full time for 18 years, I've seen and heard just about every standard election cycle promise which always converts into a lie after the candidate is sworn into office. Millions of young Americans will vote in November 2008. These young adults were in grade school when Hillary Clinton and the tramp she's married to dirtied the White House and brought shame to this nation. How I want to gag every time I hear, "You go girl!" in reference to Hillary Rodam Clinton. The females who chant this vacuous nonsense will vote for this menace to America simply because she has two mammary glands and a vagina. Needy, whining, dependent women who claim to be "liberated" and "empowered," but in fact are the ones always bitching and moaning with their hands out for more from mother government and they demand you pay for it. In the meantime, Hillary is trying very hard to look like a real man. The whole thing is revolting. Of course, it goes without saying that a real man would never vote for Hillary Clinton, although I did see a segment on cable a few weeks ago of some males walking up the street carrying a big banner that read, Hillary for President; this was in New Hampshire. I thought these are the "sensitive," kinder, gentler new breed of wimps who would support this shrew who has stood by her business partner for more than 25 years while he screws anything in skirts from 16-60. A "husband" with a rape charge hanging over his head, Hillary stands by Bill, but she won't fix him cookies. No self-respecting woman would stay married to a pig like Bill Clinton, but theirs isn't a marriage, it's a con against the American people. Both of them are narcissists who feed off each other. Some cheeky fellow sent me this e-mail last week because he took exception when I identified Hillary Clinton as a Marxist: "Hillary is not a Marxist anything you f**king moron..Jesus Christ.. what the hell is wrong with you f**ks? Try reading some Marx first you stupid f**k. You should be censored for your idiocy. he is not only not a Marxist of any sort, she is even futher away from being a commie.. she is a liberal.." Potty mouth's email is typical of what comes into my cyber mail box everyday. I'm sure his mother would be proud, but he does have that in common with Hillary who is legendary for her filthy mouth, hatred of our military and bitchy temper. But, that's what this new generation of sissies seem to want in their female politicians, or perhaps they secretly want a dominatrix experience and Hillary the Hun is the closest they will get. A further step into the Twilight Zone brings us this: "Richard Land, president of the Southern Baptist Convention's Ethics & Religious Liberty Commission, has joined the fray, sounding off in a Baptist Press column about why we, as Christians, need to be willing to overlook the evil within candidates and actually have a moral obligation to make utilitarian compromises and vote only for those who are electable." That's how slaves are made. On the very serious side, it is a difficult process for Americans in deciding who to vote for to be our next president. It is a heavy responsibility made more so by the machines that work behind the curtain and play a deadly game with our lives and country. In the end, the electoral college will cast their votes (which seem to be months BEFORE the general election) and choose for us. If there is a close outcome, guess who decides the presidency? "If no candidate receives a majority of electoral votes, the House of Representatives elects the President from the 3 Presidential candidates who received the most electoral votes." Who will control the House in November 2008? The Democrats. I can tell you unequivocally that the voting rolls in this country are so tainted with illegals, deceased, felons and what I call "extended family voting", we will have no idea as to any accurate vote count unless the voting rolls are purged before the election and only hand marked ballots (NO machines in any form) are used, counted in front of the general public before they leave the precincts. The whole purpose of giving driver's licenses to illegal aliens (NOT immigrants) is because illegals register Democrat. Period. Since 1993 I have been wearing out my vocal cords and fingers trying to get Americans to demand Congress get rid of the Motor Voter Act of 1993 because it has been the biggest tool yet in fraudulent voter registration. Registering on line is even worse. What is "extended family voting"? Registered voters, you pick any first name you like: A. Gonzalez, B. Gonzalez, C. Gonzalez, D. Gonzalez, C. Chen, D Chen, E, Chen and so on. The addresses turn out to be an empty lot in LA or empty warehouse in NYC. This is how U.S. Rep. Loretta Sanchez got "elected" and I'm convinced she's an illegal alien. Too many Americans will vote one issue: Save social security! The tried and true slogan every election cycle. Social security can't be saved. More money for education! The tried and true slogan every election cycle and despite a trillion dollars in my lifetime, America's education system is worse than a massive failure, the system is nothing more than an indoctrination engine for social engineering and to seduce America's children into accepting global governance. Females will vote for Hillary Clinton because she promises to protect their "right" to kill an unborn baby dressed up as "protecting your reproductive rights." What hogwash. Reproductive rights means a woman deciding whether or not to conceive a child. Can you show me one law in any of the 50 states of the Union that prohibits a woman's right to reproduce? Not a court order for junkies having babies while on crack, but any law that denies a woman her right to reproduce? Of course you can't, because there are no such laws. Abortion interferes with your reproductive rights. Reproduction means having a child. Abortion reverses the process. Too many Americans will vote for a candidate based strictly on name recognition. Too many Americans will not take the time to do any research into a candidate, even if that candidate is an incumbent because they're either too lazy or too afraid to find out their choice might present a moral problem for them. I wrote a column about this in June 2007. My e-mail box filled up from average, ordinary Americans who have been registered Democrats all their lives, but said they simply could not and would not vote for Clinton, Obama, Edwards or any other candidate who is pro-sodomy, pro-abortion and in Hillary's case, such an accomplished liar (“Everybody in politics lies, but [the Clintons] do it with such ease, it's troubling.” David Geffen, media mogul). This is a real dilemma for Democrats, just as it is for a lot of Republicans regarding their choices. In the next few months, these candidates will receive endorsements from various individuals which they hope will sway your vote. Last week's jaw dropper was Evangelical Christian grand poohbah, Pat Robertson, endorsing a pro-abortion (including partial birth abortion), pro-sodomy/lesbian, crook like Rudy Julie Annie. However, when you walk into the voting booth and cast your vote, it is YOUR vote and no one else's. Whether it counts or not (except for those lucky folks in New Hampshire), we must all vote our conscience and ask yourself: Is my candidate a true advocate of constitutional government and a moral individual of integrity or has he/she sold out my country? Any candidate who voted for the Patriot Act and to eliminate Habeas Corpus has no business in Congress or the White House. That would be Biden, Clinton, McCain, Hunter, Tancredo. I'm sorry, but you can't play favorites when it comes to the Constitution and Bill of Rights. That's how slaves are made. The files below contain links on candidates Clinton, Obama, Edwards, Romney, Giuliani, McCain, Huckabee and Ron Paul. While many think they know their candidate, they might be disappointed when credible facts come out. Many won't care because they want mother government, not freedom and liberty. Many won't care because their candidate has promised them the moon as they rake in the campaign cash. Big money makes for big lies. Because there is so much information on the Internet, I tried (which required countless hours of reading and sifting through junk) to find the most factual articles and columns instead of just cheer leading. There are no files for Kucinich, Thompson, Hunter, Tancredo, Richardson, Biden or Keyes. This isn't to marginalize these candidates because I know they have sincere, dedicated supporters, but I don't believe they will be in the race for the duration due to lack of money. It is the nature of a race. Please keep these in mind when you are evaluating a candidate: Jurisdiction, treaties, and executive orders. These are must reads: Creating the New Soviet Man in America, Why an Income Tax is Not Necessary to Fund the Federal Government; also available on audio to download to your IPod or a CD free; The Right argument on taxes; Collectivism vs Individualism; The factual and legal truth about social security. Patriots vs Politicians. Several dozen of my columns on these issues are available free on my site; down load to your IPod or a CD and listen while you drive. In-depth look at the candidates. Index here or go straight to file page: Romney, Obama, McCain, Edwards, Giuliani, Huckabee, Clinton, Ron Paul. Did you know the Communist Party USA endorsed John Kerry in 2004? Why? Because they felt he would continue to further the agenda for world communism via the official Democratic Party. Back in 1996, in my Blind Loyalty booklet, I outlined the 56 members of Congress who belonged to the "Progressive Caucus" and information on their twin, the DSA: Democratic Socialists of America. All Democrats. The controlled, dominant media puppets have convinced most Americans that communism is dead, but nothing could be further from the truth. Below are the goals of the communist party entered into the Congressional Record in 1963. How can anyone deny the Democrat Party has been pursuing these goals for decades? How can anyone deny the Republican Party is also pursuing the same agenda? They have just been able to hide it better - until the Internet came along and Americans suddenly found a world of credible research at their fingertips. Compare these goals to your candidate and ask yourself if this is what you want for America? The full list is here and remember, communism can only thrive in a Godless nation. Goals: Permit free trade between all nations regardless of Communist affiliation and regardless of whether or not items could be used for war. (Done); Extension of long-term loans to Russia and Soviet satellites. (Done); Provide American aid to all nations regardless of Communist domination. (Done); Grant recognition of Red China. Admission of Red China to the U.N. (Done); Allow all Soviet satellites individual representation in the U.N. (Mostly done); Promote the U.N. as the only hope for mankind. If its charter is rewritten, demand that it be set up as a one-world government with its own independent armed forces. (Done); Resist any attempt to outlaw the Communist Party. (Done and they teach openly in U.S. colleges); Do away with all loyalty oaths. (Done); Capture one or both of the political parties in the United States. (Done and in progress); Use technical decisions of the courts to weaken basic American institutions by claiming their activities violate civil rights. (Done); Get control of the schools. Use them as transmission belts for socialism and current Communist propaganda. Soften the curriculum. Get control of teachers' associations. Put the party line in textbooks. (Done); Infiltrate the press. (Done); Get control of book-review assignments, editorial writing, policy making positions. (Done); Gain control of key positions in radio, TV, and motion pictures. (Done, they call themselves liberals); Continue discrediting American culture by degrading all forms of artistic expression. An American Communist cell was told to "eliminate all good sculpture from parks and buildings, substitute shapeless, awkward and meaningless forms." (Done); Control art critics and directors of art museums. "Our plan is to promote ugliness, repulsive, meaningless art." (Done, i.e., "art" of Jesus being smeared with feces); Eliminate all laws governing obscenity by calling them "censorship" and a violation of free speech and free press. (Done); Break down cultural standards of morality by promoting pornography and obscenity in books, magazines, motion pictures, radio, and TV. (Done); Present homosexuality, degeneracy and promiscuity as "normal, natural, healthy." (Done); Infiltrate the churches and replace revealed religion with "social" religion. Discredit the Bible and emphasize the need for intellectual maturity which does not need a "religious crutch." (Done); Eliminate prayer or any phase of religious expression in the schools on the ground that it violates the principle of "separation of church and state." (Done); Discredit the American Constitution by calling it inadequate, old-fashioned, out of step with modern needs, a hindrance to cooperation between nations on a worldwide basis. (Done) Discredit the American Founding Fathers. Present them as selfish aristocrats who had no concern for the "common man." (Done); Belittle all forms of American culture and discourage the teaching of American history on the ground that it was only a minor part of the "big picture." (Done); Support any socialist movement to give centralized control over any part of the culture--education, social agencies, welfare programs, mental health clinics, etc. (Done); Eliminate all laws or procedures which interfere with the operation of the Communist apparatus. (Done); Eliminate the House Committee on Un-American Activities. (Done); Transfer some of the powers of arrest from the police to social agencies. Treat all behavioral problems as psychiatric disorders which no one but psychiatrists can understand [or treat]. (Done); Dominate the psychiatric profession and use mental health laws as a means of gaining coercive control over those who oppose Communist goals. (Done); Discredit the family as an institution. Encourage promiscuity and easy divorce. (Done big time); Emphasize the need to raise children away from the negative influence of parents. Attribute prejudices, mental blocks and retarding of children to suppressive influence of parents. (Done big time); Overthrow all colonial governments before native populations are ready for self-government. (In progress); Internationalize the Panama Canal. (Done); Repeal the Connally reservation so the United States cannot prevent the World Court from seizing jurisdiction [over domestic problems. Give the World Court jurisdiction] over nations and individuals alike. (In progress). a scene from a GREAT flic
http://en.wikipedia.org/wiki/America:_Freedom_to_Fascism America: Freedom to Fascism (also America: From Freedom to Fascism or (per the title card) America: Freedom to Fascism Volume One) is a 2006 film by Aaron Russo. It was exhibited in theaters in select U.S. cities.[1] This documentary covers many subjects, including: the Internal Revenue Service (IRS), the income tax, the Federal Reserve System, national ID cards (REAL ID Act), human-implanted RFID tags (Spychips), Diebold electronic voting machines,[2] globalization, Big Brother, taser weapons abuse,[3] and the alleged use of terrorism by government as a means to diminish the citizens' rights. Some of the premises of the film include: * The Federal Reserve banking system is unconstitutional and has maxed out the national debt and bankrupted the United States government. * Federal income taxes were imposed in response to, or as part of, the plan implementing the Federal Reserve System. * Federal income taxes are unconstitutional or otherwise legally invalid. * The use of the Federal income tax to counter the economic effects of the Federal Reserve System is futile. Although factually dubious, the film developed a "cult following among the politically disaffected."[4] Contents [hide] * 1 Federal Reserve issues and interviews in the film * 2 Federal income tax issues and interviews in the film * 3 The filmmaker's personal views on taxes * 4 The film shown at "Cannes" * 5 Criticism o 5.1 In popular media * 6 References * 7 External links [edit] Federal Reserve issues and interviews in the film The film spends a fair amount of time examining the Federal Reserve System, including its genesis and functions. The film asserts that the Federal Reserve Bank is a system of privately held, for profit corporations, not a government agency, and was commissioned to print fiat money on behalf of the federal government, at a fee ultimately paid for by the personal income tax (through service on bond interest). The film also refers to the fact that the United States dollar is not backed by gold, and claims that this means the dollar has no real backing other than future income tax payments. Consequently, the film proposes, Federal Reserve Notes represent debt instead of wealth. According to the film, the Federal Reserve System operates by manipulation of what is sometimes referred to as the business cycle of economic expansion and retraction by putting new notes into circulation to increase the ease of obtaining credit, which devalues the currency, then compounds inflation by increasing interest (prime) rates. This manipulation, according to the film, is responsible for a 96% devaluation of American currency since it was made possible to increasingly sever the link with gold backing by the Federal Reserve Act of 1913. The film says that this process of creating new money and adding it to the money supply is known as debasement and is a cause of inflation. In this way, the film asserts that the Federal Reserve Bank simultaneously controls the supply of money and its value. The central thesis of the film may be that this monetary policy is the strongest form of governance that has ever existed, and is central to the unconstitutional, global power ambitions of the interests that supposedly control the Federal Reserve. The film also asserts that the private interests it claims are controlling the Federal Reserve have been present for generations. According to the film, however, most Americans are kept ignorant of how the Federal Reserve operates through actions of corrupt politicians and an increasingly centralized media. By using what the film calls legalistic and economic "mumbo-jumbo” terms such as 'monetizing the debt' or ‘adjusting monetary policy for increased fluidity of credit’, these interests, according to the film, conceal the true actions of the Fed behind veils of legitimacy. The argument made in the film is that there is no reason why the Federal Reserve should have a monopoly on the U.S. money supply. The film asserts that, “America got along just fine before the Federal Reserve came into existence” (which, in the film maker's view, leads to the question of why the Federal Reserve System was created). The film contends that the U.S. Congress has no control or oversight over the Fed, and hence has no control over the value of U.S. money. The film argues that Congressional control over the value of money is required by Article 1, Section 8 of the United States Constitution. The phrase in question (clause 5) states that the United States Congress shall have the power "To coin Money, regulate the Value thereof, and of foreign Coin..." The film includes a call to action to abolish the Federal Reserve, echoed by Congressman Ron Paul, who claims the organization is unconstitutional.[4] [edit] Federal income tax issues and interviews in the film Through interviews with various individuals including former IRS agents, Russo sets forth the tax protester argument that, "there is no law requiring an income tax", and that the personal income tax is illegally enforced to support the activities of the Federal Reserve System. The film refers to both article 1 section 8 of the U.S. Constitution, which grants Congress the right to impose taxes, and the Sixteenth Amendment, which removes any apportionment requirement. The film disputes the legitimacy of the Amendment and contends, through a series of interviews, that there is no law imposing the income tax. One of the listed stars of the film, Irwin Schiff, was sentenced on February 24, 2006 to 13 years and 7 months in prison for tax evasion and ordered to pay over $4.2 million in restitution.[5] In pre-sentencing documents filed with the court, Schiff's lawyers had argued that he had a mental disorder related to his beliefs about taxation. Initially, the film portrays Mr. Schiff as a tax "expert," though his qualifications and those of many other "experts" in the film are not mentioned. It is not until later that the film reveals Mr. Schiff has gone to jail. Mr. Schiff appears in the film for another reason as well. The filmmaker lampoons Judge Kent Dawson's reaction to Schiff's defense. The film alleges that the judge "denied Irwin the ability to prove to a jury that there was no law requiring Americans to file an income tax return. He denied Irwin the right to attempt to prove to a jury there was no law . . . by stating, 'I will not allow the law in my courtroom.'" At 0:48:28 of the film, Mr. Russo introduces the judge and his statement. Under the U.S. legal system, the general rule (with exceptions) is that neither side in a civil or criminal case is allowed to try to prove to the jury what the law is. For example, in a murder case the defendant is not generally allowed to persuade the jury that there is no law against murder, or to try to interpret the law for the jury. Likewise, the prosecution is not allowed to try to persuade the jury about what the law is, or how it should be interpreted. Disagreements about what the law is are argued by both sides before the judge, who then makes a ruling. Prior to jury deliberations, the judge, and only the judge, instructs the jury on the law.[6] Another listed star, Vernice Kuglin, was acquitted in her criminal trial for tax evasion in August of 2003.[7] This means she was not found guilty of a willful intent to evade income taxes. (A conviction for tax evasion requires, among other things, proof by the government that the defendant engaged in one or more affirmative acts of misleading the government or of hiding income.) Kuglin entered a settlement with the government in 2004 in which she agreed to pay over $500,000 in taxes and penalties.[8] On April 30, 2007, the Memphis Daily News reported that Kuglin's Federal tax problems continued with the filing of a notice of Federal tax lien in the amount of $188,025. The Memphis newspaper also stated that Kuglin has "given up her fight against paying taxes, according to a Sept. 10, 2004, Commercial Appeal story."[9] The preview clip for the film includes assertions contradicted by official government publications regarding the activities and nature of such institutions as the Internal Revenue Service and the Federal Reserve System[10] [edit] The filmmaker's personal views on taxes As of late July 2006, Aaron Russo's biography on his website for the film stated: "The film is an exposé of the Internal Revenue Service, and proves conclusively there is no law requiring an American citizen to pay a direct unapportioned Tax on their labor." [7] [11] The New York Times article of July 31, 2006 states that when Mr. Russo asked IRS spokesman Anthony Burke (who according to the article was credited by Russo in the film) for the law requiring payment of income taxes on wages and was provided a link to various documents including title 26 of the United States Code (the Internal Revenue Code), filmmaker Russo denied that title 26 was the law, contending that it consisted only of IRS "regulations" and had not been enacted by Congress. The article reports that in an interview in late July 2006, Russo claimed he was confident on this point. In the United States "statutes" are enacted by Congress, and "regulations" are promulgated by the executive branch of government to implement the statutes. The statutes are found in the United States Code; and the regulations are found in the Code of Federal Regulations. The Treasury regulations to which Mr. Russo may have been referring are found at title 26 ("Internal Revenue") of the Code of Federal Regulations [8], not title 26 of the United States Code.[12] The argument that the Internal Revenue Code is not law, the argument that the Internal Revenue Code is not "positive law," and variations of these arguments, have been officially identified as legally frivolous Federal tax return positions for purposes of the $5,000 frivolous tax return penalty imposed under Internal Revenue Code section 6702(a).[13] The article also discloses that Russo had over $2 million of tax liens filed against him by the Internal Revenue Service, the state of California, and the state of New York for unpaid taxes. In an interview with the New York Times; however, Russo refused to discuss the liens, saying they were not relevant to his film.[14] [edit] The film shown at "Cannes" Russo's promotional materials state that the film was shown at "Cannes" in France. As of July 31, 2006, the web site (at www.freedomtofascism.com) states: America: Freedom to Fascism Opens to Standing Ovations at Cannes! The international audience at Cannes as well as the European media has been fascinated by Russo’s fiery diatribe against the direction America is heading [ . . . ] According to a New York Times article by David Cay Johnston on July 31, 2006, however, the film was not "on the program" at the 2006 Cannes Film Festival itself; Russo actually rented an inflatable screen and showed the film on the beach at the town of Cannes during the time of the film festival. The New York Times article states: "Photographs posted at one of Mr. Russo's Web sites depict an audience of fewer than 50 people spread out on a platform on the sand."[15] [edit] Criticism Aaron Russo reads a quote attributed to U.S. District Judge James C. Fox: If you...examined [The 16th Amendment] carefully, you would find that a significant number of states never ratified that amendment. The film does not mention the specific court case, which is Sullivan v. United States.[16] In the case, the plaintiffs attempted unsuccessfully to prevent the deployment of troops to Iraq. The comments with respect to the Sixteenth Amendment did not constitute a ruling in the case (see Stare decisis) and were mentioned only in passing (see Obiter dictum). The transcript reads (in part): I will say I think, you know, colonel, I have to tell you that there are cases where a long course of history in fact does change the Constitution, and I can think of one instance. I believe I'm correct on this. I think if you were to go back and try to find and review the ratification of the 16th amendment, which was the internal revenue, income tax, I think if you went back and examined that carefully, you would find that a sufficient number of states never ratified that amendment...And nonetheless, I think it's fair to say that it is part of the Constitution of the United States, and I don't think any court would ever...set it aside. The 16th Amendment is not exactly the "internal revenue, income tax" amendment. The comments by Judge Fox were mentioned in passing, without judicial review, and in a case that has nothing to do with the 16th Amendment. Lastly, Fox concludes that no court would ever set aside the 16th Amendment, making the quote as displayed in the film a contextomy. A quote by Mayer Amschel Rothschild is displayed: Give me control of a nation's money supply, and I care not who makes its laws. The narrator in the film then states "[Rothschild] knew that he and the other bankers would now control the laws of the nation," which gives the impression that Rothschild was involved in passing the Federal Reserve Act. The Federal Reserve Act was passed, however, in 1913; Rothschild died in 1812. Aaron Russo reads a quote widely attributed to Woodrow Wilson: I am a most unhappy man. I have unwittingly ruined my country. A great industrial nation is now controlled by its system of credit. We are no longer a government by free opinion, no longer a government by conviction and the vote of the majority, but a government by the opinion and duress of a small group of dominant men. However, this is a well-known conflation of several quotes, only two of which can actually be attributed to Woodrow Wilson. The source of the first two sentences is unknown, and nowhere on record can be found to be said by Wilson. The third sentence (although slightly altered in this version) is found in the eighth chapter of Wilson's book, The New Freedom,[17] and originally reads A great industrial nation is controlled by its system of credit. Our system of credit is privately concentrated. The growth of the nation, therefore, and all our activities are in the hands of a few men who, even if their action be honest and intended for the public interest, are necessarily concentrated upon the great undertakings in which their own money is involved and who necessarily, by very reason of their own limitations, chill and check and destroy genuine economic freedom. The final sentence (beginning with "We are no longer..."), although again slightly altered from its original version, can also be found in The New Freedom (ninth chapter), and in its original context, reads We have restricted credit, we have restricted opportunity, we have controlled development, and we have come to be one of the worst ruled, one of the most completely controlled and dominated, governments in the civilized world--no longer a government by free opinion, no longer a government by conviction and the vote of the majority, but a government by the opinion and the duress of small groups of dominant men. Similarly, Russo uses a quotation that has for some time been attributed to Benito Mussolini, the authenticity of which has been called into serious doubt.[18] (Additionally, the use of the word "corporate" comes from the Latin root "corpus"; hence "corporate power" refers to power of a collective group, not necessarily a business venture): Fascism should more properly be called corporatism because it is the merger of state and corporate power. The film displays a quote: "We can't be so fixated on our desire to preserve the rights of ordinary Americans." Bill Clinton, March 11, 1993 What Clinton actually said (on March 1 1993 [19]) was: We can't be so fixated on our desire to preserve the rights of ordinary Americans to legitimately own handguns and rifles—it's something I strongly support—we can't be so fixated on that that we are unable to think about the reality of life that millions of Americans face on streets that are unsafe, under conditions that no other nation—no other nations—has permitted to exist. [edit] In popular media A review by the New York Times stated that "examination of the assertions in Mr. Russo’s documentary, which purports to expose 'two frauds' perpetrated by the federal government, taxing wages and creating the Federal Reserve to coin money, shows that they too collapse under the weight of fact."[20] Another documentary drawing from the conclusions of Russo's film, appearing a year later, is Zeitgeist The Movie[21]. In its Part III: Don't Mind The Men Behind The Curtain, Zeitgeist concerns with the Federal Reserve System, the 16th amendment, the Income Tax and VeriChip as well as America: From Freedom to Fascism does and comes to the same conclusions. Commissioner, United States Tax Court, docket no. 21743-03; 2004 TNT 177-6 (Sept. 13, 2004), as cited at [2]; and Daily Digest, Memphis Daily News, April 30, 2007, at [3]. 9. ^ Daily Digest, Memphis Daily News, April 30, 2007, at [4]. 10. ^ Regarding Federal income tax, see Article I, section 8, clause 1 of the United States Constitution, the Sixteenth Amendment, and various provisions of Title 26 of the United States Code defining gross income and taxable income, imposing the tax on the taxable income of individuals and imposing obligations to file the related tax returns, including 26 U.S.C. § 1, 26 U.S.C. § 61, 26 U.S.C. § 63, 26 U.S.C. § 6012, 26 U.S.C. § 6151, 26 U.S.C. § 6651, and 26 U.S.C. § 7203. At one point in the film (playback time 1:33:37) an individual named Edwin Vieira asserts that "The definition of income in the Constitution was given in the Eisner versus Macomber case. And it turns on gains or profits that are made from some activity. So the Supreme Court has rules. Income is not wages. It's not labor. It's gain from corporate activity." The Vieira quotation does not disclose the fact that neither the U.S. Supreme Court nor any other Federal court has ever ruled that wages are not income or that income means only gain from corporate activity. The terms "wage" and "salary" do not appear in the text of Eisner v. Macomber, 252 U.S. 189 (1920). 11. ^ No Federal court at any level, either before or after the year 1913 ratification of the Sixteenth Amendment to the United States Constitution, has upheld this argument. See tax protester arguments about taxation of labor or income from labor. 12. ^ The Internal Revenue Code is a set of statutes enacted by the U.S. Congress, not a set of administrative regulations. According to the United States Statutes at Large (published by the United States Government Printing Office) the Internal Revenue Code of 1954, the predecessor to the current 1986 code, was enacted by the Eighty-Third Congress of the United States with the phrase "Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled" and was "approved" (signed into law) at 9:45 A.M., Eastern Daylight Time, on August 16, 1954, and published as volume 68A of the United States Statutes at Large. Section 1(a)(1) of the enactment states: "The provisions of this Act set forth under the heading 'Internal Revenue Title' may be cited as the 'Internal Revenue Code of 1954'. Section 1(d) of the enactment is entitled "Enactment of Internal Revenue Title Into Law", and the text of the Code follows, beginning with the statutory Table of Contents. The enactment ends with the approval (enactment) notation on page 929. The '54 Code was also separately codified as title 26 of the United States Code and, according to CCH, Inc., a publisher of legal materials, all amendments to the 1954 Code (including the Tax Reform Act of 1986 which changed the name of the '54 Code to "Internal Revenue Code of 1986") have been made in the form of Acts of Congress. The table of contents for the United States Code at the website for the Legal Information Institute at Cornell University Law School lists title 26 of the United States Code as the "Internal Revenue Code"[5], as does the table of contents at the website for the U.S. Government Printing Office[6]. See also positive law and the United States Code. 13. ^ 26 U.S.C. § 6702, as amended by section 407 of the Tax Relief and Health Care Act of 2006, Pub. L. No. 109-432, 120 Stat. 2922 (Dec. 20, 2006). See Notice 2007-30, item (2), Internal Revenue Service, U.S. Dep’t of the Treasury (March 15, 2007).
